What is involved in suing a collection agency?
I have a conversation with a collection agency on tape (it is legal here in NY to record phone conversations), where I fully believe the representative is breaking the law by committing fraud and misrepresentation. I would like to use this tape to sue them. Any one know what would be involved in a law suit of this type; what I might expect to happen. Also, anyone know how I could conact a lawyer near the Utica/Rome area that handles this type of suit?
Your best bet and free is to the contact the Attorney General's office in your state. They all have links on the website for collection agencies. Basically, as I understand it, you file a claim. It is then researched and if you are the winning party, they get fined and sometimes lose their license. You may also be entitled to funds as well.
