Tape Recording A Person Who doesn't know Being recorded?
Is it legal in OH to tape record a witness on a mini cassette player without their knowledge? Can it be used in a court case involving someone else who lives at the house? The person implicated 3 others, including himself, in illegal activities doing so, and including a victim in the case. Can I get in trouble for it?
And the person in the court case is currently in jail.
The illegal activities has nothing to do with the charges. Names are spoken that can prove it was him on tape.
As far as I am aware (I don't know what the specific laws for your area are) tape recordings are used to gather evidence by the Police, but are generally not used in court proceedings. You would not get into trouble for making the recording, however it would be unlikley that the 'evidence' would ever be used in court as it is unlikley to stand up as credible evidence.
On the other hand, it could be the source of valuable intelligence for the Police - for example if the police were investigating a crime and had two suspects, and a recording where one suspects admits the offence, they could concentrate their efforts on the suspect who had been recorded. The evidence itself would not be used in the court case, but hopefully enough evidence wiould be gathered from other sources to convict. Where no other evidence comes to light, the recording would probably not be sufficient to get a conviction.
As I say, this is my understanding of the status of recordings in court cases (other than recordings made under caution), local laws may vary...
